Payment Fees & Related Issues
There is no charge to access Pashke Consulting\'s Site. Pashke Consulting warrants that the Services represented will perform substantially and materially in the manner and functions as described in the information provided on Pashke Consulting\'s Web Site pages and under normal use by registered members of the Services in accordance of the agreement for such Services. The Users agree that the use of the Services are at the users sole risk. The Services are provided for the cleint and visitors use as is and are provided on an as available basis. Pashke Consulting expressly disclaims all warranties of any kind, whether expressed or implied and further makes no warranty that the Services meet the User s requirements, that Services will be provided uninterrupted, be secure, timely, or error-free. Clients agree and understand that any material that is uploaded, downloaded or used through the Service is done at the Members own risk. Further, any damage to Users equipment or software as a result of using such material is solely the responsibility of the User. Pashke Consulting will be held harmless in all events related to any material that is uploaded, downloaded or used through the Service.
Limited Liability
In no event will Pashke Consulting be held liable for any direct, indirect, incidental, punitive or special damages arising out of this agreement with members and visitors including but not limited to loss of data, use, profits or other items not described.
Governing Law/Venue

The Members and Visitors agree to defend, indemnify and hold Pashke Consulting harmless from and against any and all claims, losses, liability costs and expenses (including but not limited toattorneys\' fees and cost(s) of litigation arising from the Users violation of this agreement, state or federal laws or regulations, or any third party\'s rights, including but not limited to infringement of any trademark, copyright, violation of any proprietary right and/or invasion of any privacy rights. This obligation will survive the termination of the Services.
General Practices
Pashke Consulting may establish general practices and limits concerning use of the Services, and, in its sole discretion, this may impact on the established limits associated with your usage of the Service. Pashke Consulting reserves the right to assess your usage of the Services and when it exceeds defined and agreed upon limits require you to purchase Services proportionate with your usage and data storage. Pashke Consulting reserves the right to change these general practices and limits at any time, upon notice. Pashke Consulting reserves the right to terminate service if under its review Pashke Consulting determines any illegal activity is ongoing or underway in the use of its services.
Force Majeure
Neither Pashke Consulting nor the Users shall be in default if its failure to perform any obligation under this Agreement is caused solely by supervening conditions beyond that each partys reasonable control, including acts of God, civil commotion, war, strikes, labor disputes, third party Internet service interruptions or slowdowns, vandalism or hacker attacks, acts of terrorism or governmental demands or requirements.
